PLEXARIS
General Terms and Conditions | version 2.1 | September 2026
This translation is provided for convenience. In case of conflict the Dutch version prevails.
Plexaris General Terms and Conditions
These terms and conditions apply to all services of Plexaris: advice, development and management of software on commission, the Direkto platform for connected businesses, the use of Direkto by end users, and the website. They are structured in parts; only the parts that apply to your situation apply to you.
Reading guide. Part A applies to everyone. Part B applies to clients of advisory, development and management services. Part C applies to businesses that are connected to Direkto. Part D applies to end users who use Direkto or an app built on Direkto through ChatGPT, Claude, a website assistant or another channel. Part E applies to visitors to the website. Part F applies if you use SPEAQ ID.
Part A. General
A.1 Definitions
In these terms and conditions:
- Plexaris: means QSR2go Operations B.V., trading as Plexaris, established at Waaier 30b, 2451 VV Leimuiden, registered with the Chamber of Commerce (KvK) under number 62031619, tax number 854606592.
- Client: means the legal entity or business that enters into an agreement with Plexaris for Services (Part B).
- Connected Business: means the business that has itself listed on the Direkto platform or purchases an own app on it (Part C).
- End User: means any natural or legal person who uses Direkto, an Own App or a Website Assistant to search for information, request prices or click through to a Connected Business (Part D).
- Direkto: means the platform developed and managed by Plexaris that makes products and services of Connected Businesses findable and orderable through AI assistants and other channels, including the Direkto app in ChatGPT and Claude, the Direkto portal and the associated technical infrastructure.
- Own App: means a publication of the Direkto platform under the name of one Connected Business in ChatGPT, Claude or another AI platform, which shows exclusively that Connected Business.
- Website Assistant: means a chat function provided by Plexaris on the website of a Connected Business, which makes use of Direkto.
- AI Platform: means a service of a third party on which Direkto or an Own App is published, such as ChatGPT (OpenAI) and Claude (Anthropic).
- Services: means all work and deliveries of Plexaris, including advice, design, development, implementation, hosting, management and support.
- Agreement: means any agreement between Plexaris and a Client or Connected Business, including the accepted proposal and these terms and conditions.
- Content: means all data that a Connected Business supplies to Plexaris or makes available through Direkto, including product information, prices, delivery times, texts, images, manuals and claims.
- SPEAQ ID: means the identity product of Plexaris with which a user can sign in without a password.
A.2 Applicability
- These terms and conditions apply to every offer, quotation, proposal and Agreement of Plexaris and to every use of Direkto, an Own App, a Website Assistant and the website.
- General terms and conditions or purchasing conditions of a Client or Connected Business are expressly rejected, unless Plexaris has accepted them in writing.
- Deviations apply only if they have been agreed in writing and apply only to the Agreement for which they were made.
- Plexaris provides these terms and conditions before or at the conclusion of the Agreement, as an annex to the proposal. If the Agreement is concluded electronically, Plexaris makes the terms and conditions available electronically before or at the conclusion, in a manner in which they can be stored and consulted later. On request, Plexaris will send them free of charge.
- In the event of conflict between documents, the following order of precedence applies: (1) a signed written Agreement or order confirmation, (2) the accepted proposal, (3) a data processing agreement as regards the processing of personal data, (4) these terms and conditions.
- If a provision is void or is annulled, the other provisions remain in force and the parties will replace the provision with a valid provision that comes as close as possible to its purport.
A.3 Offers and formation
- Proposals and quotations of Plexaris are without obligation and valid for the period stated in them; if no period is stated, thirty days.
- An Agreement is formed by written acceptance of the proposal, by signature, or by Plexaris starting performance at the request of the other party.
- Proposals are based on the information provided by the other party. If that information proves to be incorrect or incomplete, Plexaris may amend the proposal.
- Obvious mistakes or clerical errors in proposals do not bind Plexaris.
- Lead times and schedules in proposals are indicative, unless expressly agreed as a strict deadline.
A.4 Prices and payment
- All prices are in euros and exclusive of VAT and other levies, unless stated otherwise.
- One-off amounts are invoiced as set out in the proposal; in the absence of agreement, fifty per cent on commissioning and fifty per cent on delivery. Periodic amounts are invoiced monthly in advance, commencing at the time stated in the proposal.
- Work on an hourly basis is invoiced monthly in arrears at the agreed hourly rate, with a specification.
- The payment term is fourteen days after the invoice date. If this term is exceeded, the other party owes the statutory commercial interest and the extrajudicial collection costs without any notice of default being required.
- Plexaris may adjust periodic rates annually with at least thirty days' notice. In the event of an increase above the consumer price index of Statistics Netherlands (CBS), the other party may terminate the Agreement with effect from the date on which the increase takes effect.
- In the event of payment arrears, Plexaris may, after a reminder with a period of fourteen days, suspend the Services, including pausing a listing on Direkto or an Own App.
- Set-off or suspension by the other party is excluded, unless the other party is a consumer.
A.5 Performance
- Plexaris performs the Services to the best of its knowledge and ability, as a careful contractor. All Services are obligations to use best endeavours, unless a result has been expressly agreed.
- Plexaris may engage third parties in the performance, including hosting and infrastructure providers, AI platforms and developers. Plexaris remains the point of contact.
- Plexaris determines the manner of performance, taking into account reasonable instructions of the other party.
A.6 Cooperation of the other party
- The other party supplies in good time all information, access, content, decisions and cooperation that are reasonably necessary, including access to systems, APIs, test environments and contact persons.
- Delay caused by a lack of cooperation is not at the expense of Plexaris; lead times are extended accordingly and additional costs may be charged at the hourly rate.
- The other party warrants the accuracy, completeness and lawfulness of the information and Content supplied.
A.7 Intellectual property
- All intellectual property rights in Direkto, the Direkto portal, SPEAQ ID, generic software, building blocks, methods, designs, documentation and everything that Plexaris develops in the context of the Services are vested in Plexaris or its licensors.
- The other party obtains a non-exclusive, non-transferable right to use the delivered results for the purpose for which they were made, during the term of the Agreement and, for custom work that has been paid in full, thereafter. Rights are transferred only if this has been expressly agreed in writing and the full fee has been paid.
- Generic components that Plexaris also uses or may use for other clients are never transferred.
- The rights in Content remain with the Connected Business or the Client. It grants Plexaris a licence to use, edit, translate, summarise and display the Content to the extent necessary for the Services, including display through AI platforms.
- The other party may use trade marks, logos and names of Plexaris and Direkto only with permission. Plexaris may use the name and logo of the other party as a reference, unless the other party objects to this in writing.
- Source code is not supplied, unless agreed in writing.
A.8 Confidentiality
- The parties keep confidential all information which they know or ought to know is confidential, including price arrangements, technical documentation, API data, customer data and business information.
- The obligation does not apply to information that is public, was already known, has been lawfully obtained from a third party, or must be disclosed under a legal obligation.
- The obligation continues until three years after the end of the Agreement; for personal data and source code, indefinitely.
A.9 Personal data
- To the extent that Plexaris processes personal data on behalf of the other party in the course of the Services, Plexaris is the processor and the other party is the controller. The parties enter into a data processing agreement for this purpose; the Plexaris model applies if no other has been agreed.
- The Plexaris Privacy Policy applies to the processing of personal data for which Plexaris itself is the controller.
- Both parties take appropriate technical and organisational measures and notify each other without undue delay of breaches that concern the other party.
A.10 Security and availability
- Plexaris secures its systems in accordance with the state of the art, including encryption of API keys and access tokens, separate storage per Connected Business and logging without personal data.
- Plexaris aims for high availability but does not guarantee uninterrupted operation. A service level applies only if agreed in writing.
- Plexaris may temporarily interrupt Services for maintenance, updates and security measures, where possible outside office hours and with notice.
A.11 Force majeure
- Plexaris is not required to perform any obligation if it is prevented from doing so by force majeure. Force majeure includes in any event: outages or changes at AI platforms, hosting or infrastructure providers, internet or telecommunications outages, cyber attacks, failure of third-party APIs, changes in legislation, government measures, illness of key persons and shortcomings of suppliers.
- If the force majeure lasts longer than sixty days, either party may terminate the Agreement in writing for the part not yet performed, without compensation. Work already performed will be settled.
A.12 Liability
- The liability of Plexaris for attributable failure to perform, tort or otherwise is limited per event to compensation for direct loss up to a maximum of the amount that the other party has paid to Plexaris for the Service concerned in the twelve months preceding the event, with a maximum of 25,000 euros per year. For End Users who act in the course of a profession or business and pay no fee, liability is limited to 250 euros. If the other party is a consumer, the limitations in this article apply only to the extent permitted by law.
- Direct loss means exclusively: reasonable costs of establishing the cause and extent of the loss, reasonable costs of making the defective performance comply with the Agreement, and reasonable costs of preventing or limiting loss.
- Plexaris is not liable for indirect loss, including loss of profit, lost turnover, lost savings, loss of data, reputational damage, business interruption and loss caused by third-party claims.
- Plexaris is not liable for loss arising from: incorrect or incomplete Content or information from the other party; the acts or omissions of AI platforms, including refusing, delaying, changing or removing a publication; outages or changes in APIs and systems of the other party or third parties; the outcome of a conversation between an End User and an AI assistant, to the extent that the data provided by Direkto were correct; unauthorised use of accounts or tokens by the other party or its users.
- The limitations do not apply in the event of intent or deliberate recklessness on the part of Plexaris or its managerial staff.
- Any claim lapses twelve months after the moment at which the other party became aware or could reasonably have become aware of the loss.
A.13 Indemnity
The other party indemnifies Plexaris against claims of third parties arising from the Content, from incorrect product information, prices, claims (including sustainability and certification claims) or from use of the Services in breach of the Agreement or the law.
A.14 Term and termination
- Agreements for one-off work end on delivery. Agreements for periodic Services (management, hosting, listing on Direkto, Own App, Website Assistant) are entered into for the minimum period stated in the proposal and are then tacitly renewed for an indefinite period, terminable by either party with a notice period of one month.
- Either party may terminate the Agreement in writing with immediate effect if the other party, after a notice of default giving a reasonable period, remains in attributable breach, is declared bankrupt, applies for a suspension of payments or discontinues its business.
- Upon termination, work performed and periods elapsed remain payable. Periodic amounts paid in advance are not refunded, unless the termination is attributable to Plexaris.
- Provisions which by their nature continue, such as intellectual property, confidentiality, liability and governing law, remain in force after termination.
A.15 Amendment of the terms and conditions
- Plexaris may amend these terms and conditions. Amendments are announced at least thirty days before they take effect by e-mail or through the Direkto portal, stating the amendments.
- If the other party does not agree to a material amendment to its detriment, it may terminate the Agreement with effect from the effective date. If use continues after the effective date, the new terms and conditions apply.
A.16 Assignment
The other party may not transfer rights and obligations under the Agreement without the written consent of Plexaris. Plexaris may transfer the Agreement to a group company or a legal successor, with notice.
A.17 Governing law and disputes
- Dutch law applies to all Agreements and to the use of Direkto and the website. The Vienna Sales Convention (CISG) is excluded.
- Disputes are submitted to the competent court in the district in which Plexaris is established, unless mandatory law provides otherwise. The parties will first try to resolve a dispute through consultation.
- Consumers may, within one month after Plexaris has invoked this provision in writing, choose the court that has jurisdiction by law.
Part B. Advisory, development and management services
B.1 Application
This part applies to Clients for advice, design, development of software and applications, integrations, hosting, management and support, including the development of an Own App on Direkto.
B.2 Scope and additional work
- The scope is what is stated in the proposal. What is not stated there is not part of the assignment.
- Changes or additions to the scope are additional work. Plexaris performs additional work only after the Client has approved a written estimate or, in the case of minor adjustments, on an hourly basis at the agreed rate. If no rate has been agreed, the standard Plexaris rate of 110 euros per hour exclusive of VAT applies.
- If Plexaris has included a "fair use" quantity of minor adjustments in a monthly amount, the volume stated in the proposal applies. Work beyond that is additional work.
B.3 Phasing, delivery and acceptance
- Plexaris delivers in the phases set out in the proposal. Each phase has its own delivery.
- The Client tests a delivery within ten working days and reports defects in writing and with specifics. If no report is made within that period, or if the Client puts the result into use, it is deemed accepted.
- Plexaris remedies reported defects that do not meet the agreed specifications at no additional cost. Wishes outside the specifications are additional work.
- Minor defects that do not materially impede use do not prevent acceptance; Plexaris remedies them in the next maintenance round.
B.4 Dependence on third parties
- If the Services depend on systems, APIs or cooperation of third parties (including the webshop provider or developer of the Client, AI platforms, carriers, payment services), Plexaris does not guarantee that those third parties will deliver on time or correctly. Delay caused by third parties shifts the schedule.
- Publication on an AI platform depends on the review by that platform. Plexaris prepares and handles the submission, but does not guarantee approval, lead time or continued admission. Rejection or delay by an AI platform is not a failure on the part of Plexaris.
- Plexaris may adapt the Services if an AI platform, hosting provider or other third party changes its terms, technical requirements or availability. If this leads to substantially more work, the parties will consult on the costs.
B.5 Hosting, management and support
- For management, the monthly amount covers what is stated in the proposal; in the absence of further agreement: hosting, monitoring, security updates, maintaining registrations with AI platforms, reporting and support by e-mail on working days with a response within one working day.
- Support does not include structural changes to architecture, integrations or functionality, the production of instruction material or legal review of texts.
- Plexaris makes back-ups at the frequency stated in the proposal; in the absence of agreement, daily, with a retention period of 30 days. Restoration from back-up at the Client's request is additional work, unless the loss is attributable to Plexaris.
- Upon termination of management, Plexaris will, on request, provide within thirty days an export of the configuration, content and statistics of the Client in a commonly used format (JSON, CSV). Thereafter Plexaris may delete the data. A transfer of hosting to another party is additional work.
B.6 Third-party costs and usage
- Third-party costs incurred specifically for the Client (such as domain names, licences, API usage, costs of AI platforms or of an identity service) are passed on, unless they are included in the proposal.
- For services with usage-dependent costs (including a Website Assistant that calls language models), a fair use limit stated in the proposal applies. Usage above that limit is charged at the agreed rate or, in the absence of agreement, at cost price plus fifteen per cent.
Part C. Direkto platform: connected businesses
C.1 Application and what Direkto is
- This part applies to every Connected Business, regardless of whether it only has a listing in the Direkto app or also has an Own App or Website Assistant.
- Direkto makes the offering of Connected Businesses findable and orderable through AI assistants. Direkto gives AI assistants structured information: products, prices or price indications, availability, delivery times, terms, and a link to the ordering environment of the Connected Business. Direkto does not sell, does not collect payment and does not conclude agreements on behalf of the Connected Business. Every order is concluded between the End User and the Connected Business, in the systems of the Connected Business.
- Direkto is a technical platform, not an adviser, agent or intermediary in the legal sense. To the extent that Direkto is an online intermediation service within the meaning of Regulation (EU) 2019/1150 (the P2B Regulation), the rules on suspension and termination (C.2.3), on amendment of these terms and conditions (A.15) and on ranking and complaints (C.13) also serve to implement that regulation.
C.2 Connection and consent
- Connection takes place through the Direkto portal or through onboarding supervised by Plexaris. In doing so, the Connected Business gives written consent (the consent form) to display its name, brand, offering, prices and Content through Direkto, Own Apps, Website Assistants and AI platforms, and to edit, translate and summarise the Content to the extent necessary to make it suitable for AI assistants.
- The Connected Business declares that it is authorised to give that consent and to use the Content.
- Plexaris may refuse, suspend or terminate a connection if the Content is incorrect, incomplete, misleading or unlawful, if the offering does not fit Direkto, or if the Connected Business acts in breach of these terms and conditions. Plexaris gives written reasons for a refusal or suspension, at the latest at the moment it takes effect. Plexaris announces a termination of the connection, with reasons, at least thirty days in advance, unless a legal obligation or a serious or repeated breach of these terms and conditions justifies immediate termination.
C.3 Content: responsibility of the Connected Business
- The Connected Business is fully responsible for the accuracy, completeness, currency and lawfulness of its Content, including prices, delivery times, availability, product characteristics, allergens, delivery requirements, sustainability and certification claims, and the legally required information for its products.
- The Connected Business supplies Content that corresponds with its own webshop or ordering environment. With an API connection, the Connected Business is responsible for the accuracy of what the API returns.
- The Connected Business keeps its Content up to date and reports changes that the assistant needs to know about (prices, range, delivery times, terms) without undue delay through the portal or to Plexaris.
- Claims about sustainability, certification, origin, health or quality are only displayed in the wording that the Connected Business has supplied and approved. The Connected Business warrants that such claims are substantiated and permitted.
- Plexaris may edit Content for readability, structure and translation, but does not change prices, terms or claims in substance without approval.
C.4 Prices and information through AI assistants
- Prices, delivery times and availability displayed through Direkto are indicative until confirmed in the ordering environment of the Connected Business. The Connected Business ensures that this rule is also stated in its own ordering environment and terms and conditions, so that the End User is made aware of it.
- Plexaris retrieves prices live from the systems of the Connected Business or calculates them from tables or formulas supplied by the Connected Business. Plexaris does not estimate or extrapolate prices. In the event of an outage, the assistant displays a notice or an earlier price marked as indicative.
- Plexaris is not responsible for what a third-party AI assistant does with the information provided by Direkto, provided that the data provided by Direkto were correct. AI assistants may summarise, rephrase or make errors in information; Plexaris limits this with structured data and clear instructions, but has no control over the language model of the AI platform.
C.5 AI platforms and publication
- Direkto and Own Apps are published on third-party AI platforms. Availability, review, findability, ranking, regional admission (including the European Union), functionality and terms are determined by those platforms. Plexaris guarantees none of these points.
- Plexaris cannot guarantee the findability of a Connected Business in an AI assistant. Plexaris optimises descriptions and offers additional routes (such as a direct link from the website of the Connected Business), but the AI platform determines whether and when Direkto or an Own App is suggested.
- If an AI platform changes its rules, technology or availability, Plexaris may adapt Direkto and Own Apps accordingly. If a channel ceases to exist altogether, the parties will consult; this does not give a right to a refund for periods already elapsed.
- The Connected Business accepts that the conversations between End Users and AI assistants are processed by the AI platform under the terms and privacy policy of that platform, outside the influence of Plexaris.
C.6 Own App
- With an Own App, Plexaris publishes the Direkto platform under the name of the Connected Business on one or more AI platforms, with its own description, its own privacy policy and exclusively the offering of that Connected Business.
- The Connected Business provides what the AI platforms require of it, including a verified developer account or organisation in its name, domain verification on its domain, a privacy policy and terms and conditions on its website, and (with account linking) test data for the reviewers. Plexaris supervises this and supplies drafts of the privacy and publication texts; the legal review of these is at the expense of the Connected Business.
- The Connected Business grants Plexaris the rights and access necessary to submit, manage, update and, if necessary, withdraw the Own App.
- Upon termination, Plexaris withdraws the Own App or transfers the registration, to the extent that the AI platform permits. The underlying software remains the property of Plexaris (A.7).
C.7 Account linking and order status
- If the Connected Business purchases account linking, End Users can sign in from an AI assistant to their account with the Connected Business to see customer-specific prices or order status. The Connected Business supplies a sign-in connection and the necessary endpoints for this, or has Plexaris build them as additional work.
- Plexaris stores access tokens encrypted and separately per Connected Business and uses them exclusively for the agreed functions. Plexaris does not store passwords of End Users.
- The Connected Business is responsible for the accuracy of order statuses and shipping information that its systems supply to Direkto.
C.8 Website Assistant
- A Website Assistant is a chat function provided by Plexaris on the website of the Connected Business, with the same knowledge as Direkto.
- The Website Assistant calls language models at the expense of Plexaris, within the fair use limit stated in the proposal (B.6). The Connected Business places the assistant only on the agreed domains.
- The Connected Business publishes on its website a privacy policy that mentions the use of the Website Assistant and the processors involved; Plexaris supplies the text.
C.9 Processing of personal data
- With account linking, order status, sample requests, Website Assistant and similar functions, Plexaris processes personal data of customers of the Connected Business on behalf of the Connected Business. Plexaris is the processor for this; the parties enter into the Plexaris data processing agreement.
- For usage statistics of Direkto (numbers of conversations, price requests, click-throughs, without personal data) and for the data of contact persons of the Connected Business, Plexaris is the controller; the Plexaris Privacy Policy applies to this.
C.10 Statistics, reporting and portal
- Plexaris periodically provides the Connected Business with statistics on the use of Direkto, Own App and Website Assistant, without personal data.
- The Connected Business manages its Content and settings through the Direkto portal and is responsible for the accounts and actions of its users in the portal.
- Plexaris may use aggregated and anonymised usage data to improve Direkto and for benchmarks, without traceability to the Connected Business or its customers, unless the Connected Business gives consent for this.
C.11 Rates and subscriptions
- Rates for listing, Own App, Website Assistant and options are set out in the proposal or on the Direkto rates page. In the event of a discrepancy, the proposal prevails.
- The minimum term and notice period are set out in the proposal; in the absence of agreement, a minimum period of three months from publication applies, after which the Agreement is terminable monthly with a notice period of one month (A.14).
- Pilot discounts are linked to the consideration set out in the proposal (such as a reference or case study). If that consideration is not provided, Plexaris may charge the discount after all.
C.12 Termination and data
- Upon termination, Plexaris removes the listing from the Direkto app, withdraws Own Apps and deactivates Website Assistants within thirty days, or sooner if the Connected Business so requests.
- The Connected Business may request an export of its configuration, Content and statistics up to thirty days after termination. Thereafter Plexaris deletes the data, with the exception of what must be kept by law and of aggregated statistics.
- Access tokens of End Users are revoked and deleted immediately upon termination.
C.13 Ranking, suspension and complaints
- In the Direkto app, the AI assistant of the AI platform determines which Connected Businesses are suggested, on the basis of the End User's question and the structured data provided by Direkto (category, characteristics, location, offering). Direkto orders its search results by the degree to which the search query matches the data of a Connected Business; in doing so, the name carries the most weight, followed by the category and subcategories, then the characteristics and finally the description. If a search is made by country or place, Direkto shows only Connected Businesses with that location. Plexaris does not rank on the basis of remuneration, unless this is expressly offered as a paid option and designated as such.
- If Plexaris suspends or terminates a listing for a reason other than payment arrears, the Connected Business receives a statement of reasons and the opportunity to respond.
- Complaints about Direkto can be submitted by e-mail to frank@plexaris.com or in writing to the address under Contact. Plexaris confirms receipt within five working days and responds substantively within thirty days.
Part D. Direkto: terms of use for end users
D.1 Application
- This part applies to everyone who uses Direkto, an Own App or a Website Assistant, through ChatGPT, Claude, another AI platform, a website or another channel.
- If you are a consumer, the mandatory rules of consumer law take precedence over these terms and conditions where they are more favourable to you.
D.2 What Direkto does for you
- Direkto helps you find products and services of connected businesses, request information and prices and click through to the ordering environment of that business. Direkto itself does not sell anything.
- If you place an order, you enter into an agreement with the connected business, not with Plexaris or Direkto. The terms and conditions of the connected business apply to that agreement. Questions about your order, delivery, payment, return or guarantee should be addressed to the connected business.
D.3 Information is indicative
- Prices, delivery times, availability and product information that you see through an AI assistant are indicative until you confirm them in the ordering environment of the connected business. Always check the final details there.
- The information comes from the connected business. Plexaris does not check its substance and does not vouch for its accuracy. Claims about sustainability, certification, ingredients, allergens or suitability are claims of the connected business.
- AI assistants can make errors when summarising or phrasing. In case of doubt, what is stated in the ordering environment of the connected business applies.
D.4 Signing in and account linking
- With some connected businesses, you can sign in to your account with that business from the AI assistant, for example to see your order status. You then sign in through a page of the connected business or through SPEAQ ID; an AI assistant or Direkto will never itself ask you for a password.
- You are responsible for the use of your account and the devices on which you are signed in. You can revoke a link at any time through the AI platform or the connected business.
D.5 Permitted use
- You use Direkto only for the purpose for which it is intended: searching for information, requesting prices and ordering from connected businesses.
- You may not use Direkto for unlawful purposes, to disrupt or overload systems, to collect data automatically, to circumvent or manipulate its operation (including attempting to influence the instructions to the AI assistant), or to gain access to the data of others.
D.6 Your data
- What you type into an AI assistant is processed by the AI platform (such as OpenAI or Anthropic) under the terms and privacy policy of that platform. Direkto receives only the structured requests that the assistant sends to Direkto (such as a product search or price request), not your whole conversation.
- How Plexaris handles your data is set out in the Plexaris Privacy Policy. With an Own App or Website Assistant, the privacy policy of the connected business applies in addition.
D.7 Liability
- Direkto is provided as is. Plexaris does not guarantee that Direkto is always available or free of errors, or that a connected business will deliver what it offers.
- Plexaris is not liable for loss arising from incorrect information from a connected business, from the acts of an AI platform, or from an agreement between you and a connected business. Otherwise, A.12 applies, subject to mandatory consumer law.
D.8 Complaints
If you have a complaint about Direkto itself (not about an order), send an e-mail to frank@plexaris.com or write to the address under Contact. Plexaris will respond within thirty days.
Part E. Website
E.1 Use of the website
- The Plexaris website and the information, documents, forms and tools offered on it are intended for information purposes. No rights can be derived from the content.
- You may not use the website for unlawful purposes, disrupt systems, collect data automatically, or copy, modify or decompile the software or content without permission.
E.2 Intellectual property and submissions
- All content on the website, including texts, images, logos, software and methodologies, is the property of Plexaris or its licensors and partners. Use is permitted only for personal or internal business consultation.
- If you send us ideas, suggestions or material (feedback), Plexaris may use them freely without compensation, unless you have agreed otherwise in writing in advance. Do not send us confidential information without a prior confidentiality agreement.
E.3 Partners and references
- For Direkto, Plexaris works with the following suppliers: Supabase (database), Vercel (hosting), Resend (e-mail) and Google (back-ups and language model). Their services are subject to their own terms and conditions.
- References to websites or services of third parties are for information purposes; Plexaris is not responsible for their content or privacy policy.
E.4 Product, nutritional and regulatory information
Information about ingredients, recipes, nutritional values, allergens or regulatory status displayed through the website or the food services of Plexaris is not guaranteed to be complete, up to date or suitable for your application. You are yourself responsible for validation and compliance with the laws and regulations that apply to you.
E.5 Age
The website and Services are aimed at businesses and at persons aged sixteen and over.
Part F. SPEAQ ID
- SPEAQ ID is a separate product of Plexaris with which users can sign in without a password using a key pair on their own device. The SPEAQ ID privacy policy, which can be found at speaq.id/privacy, applies to the use of SPEAQ ID.
- A Connected Business or Client may purchase SPEAQ ID as an option for its customers. The purchase, rates and data processing arrangements for SPEAQ ID are agreed separately.
- For End Users: with SPEAQ ID, Plexaris does not store a password, e-mail address or telephone number for signing in; identity is confirmed with a cryptographic signature from the user's device. Loss of the device or the key is at the user's risk, subject to the recovery options that SPEAQ ID offers.
